Privacy Policy

1. Introduction

This Privacy Policy applies to Harvey & Company LLC, a California limited liability company, its affiliates, operating divisions, branches, and subsidiaries, which may be referred to as “Harvey,” “we,” or “us.” This Privacy Policy explains our online and offline information practices, the kinds of information we may collect, how we intend to use and share that information, and how you (“you” includes the user, consumer, purchaser, prospective customer, or the like) can opt-out of a use, correct, or change such information. All terms are defined in Section 13 or otherwise herein.

2. Scope

This Privacy Policy applies to Personal Information that is Processed by Harvey in the course of our business including on the www.harveyllc.com website (the “Site”), mobile applications, forums, blogs, and other online or offline offerings (together with any online and offline offerings operated by or on behalf of Harvey, the “Service” or “Services”). This Privacy Policy is incorporated into Harvey’s agreements with customers. All individuals whose responsibilities include the Processing of Personal Information on behalf of Harvey are expected to protect that data by adherence to this Privacy Policy. This Privacy Policy is intended to meet requirements globally, including those in North America and Europe. In certain instances, we may act as either a Controller or Processor of Personal Information. 3. How We Collect and Use Personal Information

The types of Personal Information we may collect (directly from you or from Third-Party sources) and our privacy practices depend on the nature of the relationship you have with Harvey and the requirements of applicable law.

We endeavor to collect only that information which is necessary for a business purpose and relevant for the purposes of Processing. Below are the ways we collect Personal Information and how we use it.

3.1 Type of Personal Information We Collect

Harvey collects Personal Information regarding its current, prospective, and former clients, customers, users, visitors, and guests (each an “Individual” and, collectively “Individuals”).
Information You Provide Directly to Us. When you use the Services or engage in certain activities, such as requesting Services or information or contacting us directly, we may ask you to provide some or all of the following types of information:

• Staying in Touch. Harvey may communicate with you via physical mailings, emails, phone calls, and SMS messages in accordance with your communication preferences. You can opt-out of these communications at any time by following the instructions under Section 5.
• Data We Collect Automatically. We may collect certain information automatically through our Services or other methods of web analysis, such as your Internet Protocol (IP) address, cookie identifiers, mobile carrier, mobile advertising identifiers, MAC address, IMEI, Advertiser ID, mobile applications actually used to interact with Harvey, and other Device identifiers that are automatically assigned to your computer or Device when you access the Internet, browser type and language, geo-location information, hardware type, operating system, Internet service provider, pages that you visit before and after using the Services, the date and time of your visit, the amount of time you spend on each page, search activity, information about the links you click and pages you view within the Services, and other actions taken through use of the Services such as preferences.
• Information from Other Sources. We may collect or receive information about you from other sources, including through Third-Party services and organizations, including Third-Party Partners, to supplement information provided by you. This supplemental information allows us to verify information that you have provided to Harvey and to enhance our ability to provide you with information about our business and Services.

3.2 How Harvey Uses Your Personal Information/ Business Purpose

We may use the Personal Information we collect for some or all of the following business purposes:

• Auditing related to a current interaction with you and concurrent transactions, including but not limited to, counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with privacy laws, this privacy policy, and other standards.
• Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity.
• Debugging to identify and repair errors that impair existing intended functionality.
• Short-term, transient uses, provided the Personal Information is not disclosed to another Third-Party and is not used to build a profile about a consumer or otherwise alter an individual consumer’s experience outside the current interaction, including, but not limited to, the contextual customization of ads shown as part of the same interaction.
• Performing Services, including providing customer Service, Processing transactions, verifying customer information, processing payments, providing financing, providing advertising or marketing Services, providing analytic Services, or providing similar Services.
• Undertaking internal research for technological development and demonstration.
• Undertaking activities to verify or maintain the quality of a Service provided by Harvey, and to improve the Service that is provided by Harvey.

3.3 Legal Basis for Processing Personal Information (EEA visitors only)

If you are a visitor from the EEA, our basis for collecting and using your Personal Information will depend on the Personal Information concerned and the specific context in which we collect it.

We may collect information from you in the following ways: (i) with your consent; (ii) in order to perform our contractual obligations with you; (iii) where Processing of the information is within our legitimate business interests and such business interest is not overridden by your data protection interests or fundamental rights and freedoms; or (iv) in order to perform our legal obligations or to protect your vital interests or the vital interests of another. If legally permissible, we will inform you that we are collecting your Personal Information and whether the collection of the information is mandatory or not, including the possible consequences if you do not provide the information requested (e.g., our inability to perform certain requests).

3.5 Cookies, Pixel Tags/Web Beacons, Analytics Information, and Interest-Based Advertising

We, as well as Third-Party Partners that provide content, advertising, or other functionality on our Services, may use cookies, pixel tags, local storage, and other technologies (“Technologies”) to automatically collect information through the Services. We use Technologies that are essentially small data files placed on your computer, tablet, mobile phone, or other similar Device that allow us to record certain pieces of information whenever you visit or interact with our Site, Services, applications, messaging, and tools, and to recognize you across Devices.

Cookies, GIFs, and HTML5. We, and our Third-Party Partners, use cookies, scripts, and tags on our Site. A cookie is a piece of data stored on a website visitor’s hard drive to help us improve your access to our Site and identify repeat visitors to our Site. Cookies can also enable us to track and target the interests of our users to enhance the experience on our Site. Additionally, we use cookies to track our online advertising efforts. If you wish to not have this information used for the purpose of serving you interest-based ads, you may opt-out by contacting us at info@harveyllc.com. Please note this does not opt you out of being served untargeted ads.

Our Third-Party Partners may also use other tracking technologies, such as clear GIFs (a.k.a. web beacons/web bugs), that help us better manage content on our Site by informing us what content is effective. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users.

We may also use clear GIFs in our HTML-based emails to let us know which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. If you would like to opt-out of these e-mails, please see Section 5.

We, and our Third-Party Partners, may use Local Shared Objects (Flash cookies) or Local Storage (HTML 5), to store content information and preferences. Various browsers may offer their own management tools for removing HTML 5. To manage Flash, please contact us at info@harveyllc.com.

Social Media Features and Widgets. Our Site may include social media features, such as the Facebook Like button and widgets, such as the “Share This” button or interactive mini-programs that run on our Site. These features may collect your IP address, which page you are visiting on our Site, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a Third-Party Partner or hosted directly on our Site. Your interactions with these features are governed by the privacy policy of the company providing it.

Analytics. We may also use Google Analytics and Google Analytics Demographics and Interest Reporting to collect information regarding visitor behavior and visitor demographics on some of our Site and Services, and to develop website content. Our uses of such Technologies fall into the following general categories and meet a legitimate business purpose:

• Operationally Necessary. We may use cookies, web beacons, or other similar technologies that are necessary to the operation of our Site, Services, applications, and tools. This includes technologies that allow you access to our Site, Services, applications, and tools; that are required to identify irregular Site behavior, prevent fraudulent activity and improve security; or that allow you to make use of our functions such as shopping-carts, saved search, or similar functions.
• Performance Related. We may use cookies, web beacons, or other similar technologies to assess the performance of our Site, applications, Services, and tools, including as part of our analytic practices to help us understand how our visitors use our Site, determine if you have interacted with our messaging, determine whether you have viewed an item or link, or to improve our Site content, applications, Services, or tools.
• Functionality Related. 3.6 Third-Party Websites, Social Media Platforms, Software Development Kits

The Site may contain links to other websites and other websites may reference or link to our Site or other Services. These other domains and websites are not controlled by us, and Harvey does not endorse or make any representations about Third-Party or Third-Party Partner websites or social media platforms. We encourage our users to read the privacy policies of each and every website and application with which they interact. We do not endorse, screen or approve, and are not responsible for the privacy practices or content of such other websites or applications. Visiting these other websites or applications is at your own risk.

Harvey’s Services may include publicly accessible blogs, community forums, or private messaging features. The Site and our other Services may also contain links and interactive features with various social media platforms (e.g., widgets). If you already use these platforms, their cookies may be set on your Device when using our Site or other Services. You should be aware that Personal Information which you voluntarily include and transmit online in a publicly accessible blog, chat room, social media platform or otherwise online, or that you share in an open forum may be viewed and used by others without any restrictions. We are unable to control such uses of your information when interacting with a social media platform, and by using such services you assume the risk that the Personal Information provided by you may be viewed and used by Third-Parties for any number of purposes.

3.7 Third-Party Partner Payment Processing

When you make purchases through the Services, we Process your payments through Third-Party Partner applications. The Third-Party Partner application may collect certain financial information from you to Process a payment on behalf of Harvey, including but not limited to, your name, email address, address and other billing information.

4. Onward Transfer – Harvey May Disclose Your Information

4.1 Information We Share

We may share your information as described in this Privacy Policy; e.g., with a Third-Party or Service Providers, to comply with legal obligations, to protect and defend our rights and property, or with your permission.

• Service Providers. From time to time, we may disclose your Personal Information to organizations that perform Services. For example, to provide customer Service, to ship items, to Process credit cards, for research, for marketing, for data Processing, and to measure the use of our Site. We will only share the Personal Information necessary for these companies to perform work on our behalf. Your Personal Information will be provided to these organizations pursuant to a written agreement that prevents them from retaining, using, or disclosing the Personal Information for any reason other than the purpose of providing Services under the instructions of Harvey, and with respect to that information, to keep it secure and act in a manner consistent with the relevant principles articulated in this Privacy Policy.
• Compliance with Law. We may disclose your data to any competent law enforcement body, regulatory, government agency, court or other Third-Party where we believe disclosure is necessary, for example, (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, or (iii) to protect your vital interests or those of any other person.
• Mergers and Acquisitions. We may disclose your data to a potential buyer of Harvey (and its agents and advisors) in connection with any proposed purchase, merger or acquisition of any part of our business, provided we inform the buyer it must use your Personal Information only for the purposes disclosed in this Privacy Policy. If Harvey is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Site of any change in ownership.

4.2 International Data Transfers

You agree that all Personal Information collected by Harvey may be transferred, Processed, and stored anywhere in the world, including but not limited to, the United States, Australia, Singapore, or Ireland, as well as the European Union, in the cloud, on our servers, on the servers of our affiliates or the servers of our Service Providers, our group companies, and partners that may operate around the world.

If any transfer of Personal Information of residents of the European Economic Area (“EEA”) is made to a person or entity located in a country outside of the EEA that is not recognized as providing an adequate level of protection, we will provide for increased information security and appropriate contractual provisions to strengthen data protection. To ensure that any such transfers of the Personal Information of EEA residents are compliant with applicable laws, we will either (i) conclude a data transfer agreement, based upon the EU model agreements, (ii) adopt binding corporate rules, (iii) rely on legally determined exceptions (such as requesting your explicit consent), or (iv) adopt other mechanisms which have been deemed to provide for the adequate protection of your Personal Information.

4.3 Selling

We do not trade, rent, or sell your Personal Information. Although we may share your information with others, such as Agents, Service Providers, or Third-Party Partners, we only disclose the minimum amount of Personal Information necessary.

5. Opt-Out (Right to Object to Processing)

5.1 General

You have the right to object to and opt-out of certain uses and disclosures of your Personal Information. Where you have consented to Harvey’s Processing of your Personal Information you may withdraw that consent at any time and opt-out to further Processing by contacting us at info@harveyllc.com. Even if you opt-out, we may still collect and use non-Personal Information regarding your activities on our Site, Services, and/or information from the advertisements on Third-Party websites for non-interest-based advertising purposes, such as determine the effectiveness of the advertisements, or use your Personal Information for legitimate business purposes including fulfillment of billing or contractual obligations, as well as legal requirements.

5.2 Email and Telephone Communications

If you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt-out of receiving future emails. We will Process your request within a reasonable time after receipt. Note that you will continue to receive transaction-related emails regarding Services you have requested or used.

5.3 “Do Not Track”

Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.

5.4 COOKIES AND INTEREST-BASED ADVERTISING

As noted above, you may stop or restrict the placement of cookies on your computer or remove them from your browser by adjusting your web browser preferences. Please note cookie-based opt-outs are not effective on mobile applications. However, on many mobile Devices, application users may opt-out of certain mobile ads via their Device settings.

To be clear, whether you are using our opt-out or an online industry opt-out, these cookie-based opt-outs must be performed on each Device and browser that you wish to have opted-out. For example, if you have opted-out on your computer browser, that opt-out will not be effective on your mobile Device. You must separately opt-out on each Device.

6. Right of Access, Rectification, Erasure, And Restriction

6.1. Your California Privacy Rights

If you are a resident of California, you have certain rights pursuant to the California Consumer Privacy Act and the Shine the Light law. Those rights are detailed in this Section 6.1. A. RIGHT TO KNOW ABOUT PERSONAL INFORMATION COLLECTED, DISCLOSED OR SOLD

You have the right to request that Harvey disclose the following information to you about our collection and use of your personal information in connection with the Harvey’s use over the last 12 months:

• The categories of personal information we collect about you.
• The categories of sources for the personal information we collect about you.
• Our business or commercial purpose for collecting or selling that personal information.
• The categories of third parties with whom we share that personal information.
• The specific pieces of personal information collected about you.
• If we disclosed your personal information for a business purpose, a list of the categories of personal information we have disclosed in the prior 12 months.
• If we have not disclosed your personal information in the preceding 12 months, we will disclose that upon request.

B. RIGHT TO REQUEST DELETION OF PERSONAL INFORMATION

You also have the right to request that Harvey delete any of your personal information that we have collected and retained. We will not delete your information if we need it to protect the security or functionality of our operations, to comply with legal obligations, or for certain other reasons.

C. PROCESS HARVEY WILL USE TO VERIFY REQUEST TO DISCLOSE OR DELETE CALIFORNIA RESIDENT’S PERSONAL INFORMATION

A request to disclose or delete your information must include enough information to allow us to reasonably verify you are the person we collected personal information about, a resident of California, and it must describe your request with enough detail to allow us to properly understand, evaluate, and respond to it. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

D. SHINE THE LIGHT LAW

Harvey does not share your Personal Information with any Third Party for that party’s direct marketing purposes. Without limiting the generality of the foregoing, no mobile information will be shared with Third Parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any Third Parties.

6.2 For EEA Residents, Pursuant to the General Data Protection Regulation or Equivalent Local Legislation, you may have the following rights:

• Subject Access Right. You can ask us to provide you with a copy of the Personal Information that we hold about you and a description of how we use your Personal Information.
• Right to Rectification. If you believe any Personal Information we hold about you may be inaccurate or incomplete, you can ask us to rectify these inaccuracies.
• Right to Erasure / Right to be Forgotten. You can ask us to erase your Personal Information in certain circumstances:
  • the Personal Information is no longer necessary in relation to the purposes for which it was collected and Processed;
  • our legal grounds for Processing is consent, you withdraw consent and we have no other lawful basis for the Processing;
  • our legal grounds for Processing is that the Processing is necessary for legitimate interests pursued by us or a Third Party Partner, you object to our Processing and we do not have overriding legitimate grounds;
  • you object to our Processing for direct marketing purposes;
  • your Personal Information has been unlawfully Processed; or
  • your Personal Information must be erased to comply with a legal obligation to which we are subject.
• Right to Data Portability. Where you have consented or have entered a contract with us, and we Process your Personal Information using automated means, you can ask us to supply that information to another party in a machine-readable format.
• Right to Restriction of Processing. You can ask us to restrict or suspend our Processing of your Personal Information in certain limited circumstances:
  • for a period enabling us to verify the accuracy of your Personal Information where you have contested the accuracy of the Personal Information;
  • your Personal Information has been unlawfully Processed and you request restriction of Processing instead of deletion;
  • your Personal Information is no longer necessary in relation to the purposes it was collected and Processed for, but the Personal Information is required by you to establish, exercise or defend legal claims; or
  • for a period enabling us to verify whether the legitimate grounds relied on by us override your interests where you have objected to Processing based on it being necessary for the pursuit of a legitimate interest identified by us.
• Right to Object to Processing. You have the right to object to our Processing of your Personal Information in certain circumstances where we Process your information on the lawful basis of our legitimate interests when:
  • our legal grounds for Processing is that the Processing is necessary for a legitimate interest pursued by us; or
  • our Processing is for direct marketing purposes. If you object, your Personal Information will subsequently no longer be used for direct marketing purposes but will be retained on a suppression list.
• Right to Withdraw Consent. If we Process Personal Information based on your express consent, you have the right to withdraw this consent at any time. We do not generally Process Personal Information based on express consent because we can usually rely on another legal basis. However, please note that this will not affect the lawfulness of any Processing of your information carried out before you withdraw your consent. The consents obtained are independent from each other; therefore, you can often revoke one, without affecting the others. Revoking your consent may mean that we are no longer able to provide you with the same services.

Although Harvey makes good faith efforts to satisfy each request for access, rectification, and erasure, there may be circumstances in which Harvey is unable to provide access to an individual’s Personal Information. If Harvey determines that access should be restricted in any particular instance, we will provide you with an explanation of why that determination has been made and a contact point for any further inquiries. In all cases, to protect your privacy, Harvey will take commercially reasonable steps to verify your identity before granting access to or making any changes to your Personal Information.

We will not discriminate against you if you choose to exercise any of your rights in accordance with this Privacy Policy.

7. Data Retention

We retain Personal Information we collect from you where we have an ongoing legitimate business need to do so. For example, we will retain your information for as needed to provide you Services. If you wish to request that we no longer use your information to provide you Services, contact us at info@harveyllc.com.
Please note that if you ask us to delete your Personal Information we will endeavor to comply with your request in compliance with applicable law, but we may need to retain and use some information where necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

8. Security of Your Information

We take steps in accordance with good industry practice to protect the information, including Personal Information, we collect from you from unauthorized access, disclosure, alteration, or destruction. We do this by implementing and maintaining reasonable security procedures and practices appropriate to the nature of the Personal Information that we collect and Process about you. The measures we use are intended to provide a level of security appropriate to the risk of Processing your Personal Information.
Your data is accessed by Harvey as required to support the Services, and access is limited to only those within the organization with the need to access to support the Services.
Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your Personal Information, Harvey cannot guarantee the security of any information you transmit to us or from our Services.

9. International Users

By using a Site, Harvey will transfer the data of international users to the United States. By choosing to visit a Site, utilize the Services or otherwise provide information to us, to the extent allowed by law, international users agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed and construed in accordance with the laws of the State of California, and without giving effect to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the appropriate state or federal court in the Orange County, California.
If you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your information to the United States and to Processing of your data globally. By providing your Personal Information, you consent to any transfer and Processing in accordance with this Privacy Policy.

10. Children’s Privacy

The Site and Services are not directed to children under 13 (and in certain jurisdictions under the age of 16) years of age, and Harvey does not knowingly collect Personal Information from children under 13 (and in certain jurisdictions under the age of 16) years of age. If you learn that we have collected your child’s Personal Information without your consent, you may alert us at info@harveyllc.com. If we learn that we have collected any Personal Information from children under 13 (and in certain jurisdictions under the age of 16), we will promptly take steps to delete such information.

11. Redress and Accountability

11.1 Questions or Lodging a Complaint

Please include your full name, email address and a detailed description of your data request. Harvey will contact you verifying the request in a reasonable time period. We will address your concerns and attempt to resolve any privacy issues in a timely manner. We hope that we can resolve any question or concern you raise about our use of your information.

11.2 California Residents

California law permits California residents to request and obtain from us twice a year, free of charge, a list of the Third-Parties to whom we have disclosed their Personal Information (if any) for our direct marketing purposes in the prior calendar year, as well as the type of Personal Information detailed in Section 6.1, and disclosed to those parties. Harvey does not sell Personal Information to Third-Parties for their own marketing purposes.

11.3 European Economic Area (“EEA”) Residents

In compliance with the GDPR principals, Harvey is committed to resolving complaints about your privacy and our collection or use of your Personal Information. EEA individuals with inquiries or complaints regarding this privacy policy should contact us at info@harveyllc.com with “Privacy Related Question” in the subject line. Please provide a detailed description of your privacy related question so we can adequately respond.

If you have unresolved privacy or data use questions or concerns that we have not addressed satisfactorily, the GDPR also gives you the right to lodge a complaint with a supervisory authority, in particular in the European Union state where you work, normally live, or where any alleged infringement of data protection laws occurred. You may file a complaint with a data protection authority about our collection and use of your Personal Information. For more information, please contact your local data protection authority. 11.4 Worldwide Inquiries and Concerns

Please provide us with specific details regarding your complaint together with any supporting evidence.
We will investigate the issue and determine the steps that are needed to resolve your complaint appropriately. We will contact you if we require any additional information from you and will notify you in writing of the outcome of the investigation.

12. Changes to Harvey’s Privacy Policy and Practices

This Privacy Policy may change from time to time. You understand and agree that you will be deemed to have accepted the updated Privacy Policy if you use the Site or Services after the updated Privacy Policy is posted on the Site. Please note that if we make any material changes to this Privacy Policy, we will post a notification and a link within the Site so you may review the updated Privacy Policy. If at any point you do not agree to any portion of the Privacy Policy then in effect, you must immediately stop using the Site and Services.

• Revision to the Privacy Policy. We may revise this Privacy Policy in our sole discretion, so review it periodically. If you continue to visit our Site and use the Services made available to you after such changes have been made, you hereby provide your consent to the changes. The date at the top of the then current Privacy Policy will tell you when it was last revised.
• Posting of Revised Privacy Policy. If there are any material changes to this Privacy Policy, Harvey will post a notification and link within the Site, and may notify you by email, ask you to re-accept the Privacy Policy, or notify you as otherwise required by applicable law. A revised version of the Privacy Policy will be effective immediately when it is posted (or upon notice as applicable).
• New Uses of Personal Information. Additionally, before we use Personal Information for any new purpose not originally authorized by you, we will provide information regarding the new purpose and give you the opportunity to opt-in in certain jurisdictions, and otherwise to opt-out. Where consent of the Individual for the Processing of Personal Information is required by law or contract, Harvey will comply with the law or contract.
• Processors and Sub-processors. You may contact info@harveyllc.com for a list of Harvey’s current Processors and sub-processors. This list may change from time to time.

13. Definitions

The following capitalized terms shall have the meanings herein as set forth below.

• “Agent,” “Service Provider,” or “Third-Party Partner” means any company, natural or legal person, public authority, agency or body that Processes Personal Information pursuant to the instructions of, and solely for, Harvey or to which Harvey discloses Personal Information for use on its behalf, and who has a written contract with Harvey.
• “Controller” means the business, natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the Processing of Personal Information; where the purposes and means of such Processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.
• “Device” means any physical object that is capable of connecting to the Internet, directly or indirectly, or to another device.
• “Personal Information” means any information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with an Individual, household, or Device.
• “Process,” “Processing,” or “Processed” means any operation which is performed upon Personal Information, whether or not by automatic means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction.
• “Processor” means a natural or legal person, public authority, agency or other body that processes Personal Information on behalf of a Controller, and pursuant to the Controller’s instructions.
• “Third-Party” or “Third-Parties” means any company, natural or legal person, public authority, agency, or body other than the Individual, Harvey, or Harvey’s Agents, Service Providers, or Third-Party Partners.
